Mueller Sports Medicine, Inc. Privacy Policy

Mueller Sports Medicine, Inc. ("Mueller") respects the privacy of personal data, and we are committed to compliance with applicable laws regarding personal data.  This Privacy Policy sets out how Mueller uses and protects any personal data collected by Mueller, for example from resellers doing business with Mueller or from consumers who buy directly from Mueller.

 

Scope and Consent

This privacy policy applies only to personal data (data about an identified or identifiable natural person) collected and used on Mueller's behalf by Mueller employees or by contractors under Mueller's control.  By providing Mueller with your personal data, you are consenting to the terms of this Privacy Policy.

 

What personal data does Mueller collect from resellers?

Personal data collected from resellers is stored in electronic form in Mueller's customer relationship management ("CRM") system and in Mueller's enterprise resource planning ("ERP") system.  If you are a reseller, we will collect contact information (names, email addresses, phone numbers, etc.) for your staff persons in specific areas like sales and accounts payable.  If you request credit terms from Mueller and a personal guaranty is required, we will collect personal data for that.

 

What personal data does Mueller collect from consumers?

Personal data collected from consumers on www.muellersportsmed.com is stored in electronic form by Mueller's e-commerce merchant and fulfillment partners.  If you are a consumer who places an order on www.muellersportsmed.com, we will collect contact information (your name, shipping and billing address, telephone number, email address, etc) and payment information (credit card information). We also maintain a record of your product purchases.

 

How does Mueller use personal data?

Mueller does not sell personal data or provide it to third parties except as described in this Privacy Policy. Mueller uses personal data in its own routine business operations to:

  • Process and fulfill orders placed by consumers or resellers for Mueller products.  For example, we may contact you using personal data to talk about the order and we may use your credit card/ACH and payment information to pay for the order.  We may also give personal data to delivery services (like UPS or FedEx), to Mueller's credit card processor, to customs authorities, or to other third parties when needed.
  • Provide customer service or support such as providing information about products or their use, or receiving product complaints or adverse incident reports, for example by using your personal data so we may respondto your inquiry or to follow up a.
  • Send promotional and marketing content regarding products or events to consumers or resellers, to get feedback or based on their needs or requests.    For example, we may use your personal data to provide you with notices of new product releases and service developments, or about upcoming meetings, events, or promotions.
  • To improve Mueller's web site and shopping experience.  For example, we use cookies to understand how our web site is being used, and to recognize and welcome consumers who visit our web site.  We may use personal data to follow-up with consumers who abandon shopping carts and do not complete checkout.

 

How can you control your personal data?

You can change and control your personal data collected and used by Mueller in several ways.  If you are a consumer who has placed an order on www.muellersportsmed.com, you can update or correct your contact information and communication preferences by logging into your account at www.muellersportsmed.com/account and using the Account Settings options.  If you are a reseller, you can update or change your contact information through your customer service representative or Mueller's privacy contact shown below.  You can unsubscribe from Mueller email using the method provided in the email.  You can ask Mueller to delete your personal data collected and used by Mueller via Mueller's privacy contact below.

 

Personal data about minors and children

Mueller does not knowingly collect personal data from or about children under 16 without the permission of parent(s)/guardian(s). If we learn that we have collected personal data from a child under 16, we will delete that personal data.  Please contact Mueller's privacy contact below if you believe Mueller has personal data from or about a child under age 16.

 

How will you know if the Privacy Policy is changed?

Mueller may update its Privacy Policy from time to time. We may notify consumers and resellers by email, or by means of a notice on this website, so we encourage you to periodically review this page for the latest information on our privacy practices.

Logging practices

Mueller and its e-commerce contractors may record the Internet Protocol (IP) addresses of visitors to Mueller's web site, and these IP addresses can sometimes be used to identify a particular person.  Mueller and its e-commerce contractors may also keep track of (A) the web sites that users visited immediately prior to visiting Mueller's website ,(B) the search terms visitors use to find Mueller's website, (C) the pages visited on Mueller's website, (D) how much time is spent on each page, (E) the types of searches done on them and (F) information about the visitor's web browser, computer, and operating system.  However, Mueller and its e-commerce contractors use this information only for statistical purposes, not in a personally identifiable way that identifies any particular person.

 

External links behavior

Mueller's website may contain links to other sites created and maintained by third parties and not subject to Mueller's control.  This Privacy Policy applies only to Mueller's website.

 

Cookies

Mueller uses cookies (electronic placeholders that are placed on your device) to track your individual movements on Mueller's website over time. Mueller uses both session-based cookies (which last only for the duration of your session) and persistent cookies (which remain on your device even after your session is over) to enhance the user experience on our website.

 

Do Not Track (DNT)

The online advertising industry has self-regulatory initiatives designed to provide consumers a choice in the types of ads they may see online and to conveniently opt-out from online behavioral ads served by some or all of the companies participating in these programs. Mueller's websites do not respond to DNT consumer browser settings.

 

Transfer of personal data to other countries or third parties

Although based in the United States, Mueller conducts activities in foreign countries that require use or transfer of personal data to Mueller employees or contractors located outside the United States. 

 

Mueller may provide your personal data in response to duly authorized information requests made by governmental authorities or otherwise required by law.  In the event of bankruptcy, merger, acquisition, reorganization or sale of assets, your personal data may be sold or transferred as part of that transaction. The promises in this privacy policy will apply to your personal data as transferred to the new entity.

 

Your European Union privacy rights

Under the General Data Protection Regulation (Regulation EU 2016/679) (also known as GDPR), if you are an individual protected by the GDPR you may have certain rights as a data subject. To request information about or avail yourself of those rights, please send an email to privacy@muellersportsmedicine.com with "GDPR Request" in the subject line. In the email please describe, with specificity, the GDPR right you are requesting assistance with.  Mueller may need additional information from you in order to respond, and (depending on the request) Mueller may choose to charge a fee for your request.  Mueller’s will review your request and notify you whether your request has been granted, denied, or if exemptions apply.

 

Your California privacy rights

Under California Civil Code Section 1798.83 (also known as S.B. 27), if you are a California resident and your business relationship with Mueller is primarily for personal, family, or household purposes, you may request certain data regarding Mueller’s disclosure, if any, of personal data to third parties for the third-parties’ direct marketing purposes. To make such a request, please send an email to privacy@muellersportsmed.com with "Request for California Privacy Information" in the subject line. You may make such a request up to once per calendar year. If applicable, we will provide you, by email, a list of the categories of personal data disclosed to third parties for their direct marketing purposes during the immediately preceding calendar year, along with the third parties' names and addresses. Please note that not all personal data sharing is covered by S.B. 27's requirements.
